PROBATE MATTERS
What type of matters are handled by the Probate Court?
The Probate Court handles a variety of matters dealing with decedent estates, wills, trusts, guardianship, conservatorship, involuntary treatment of the mentally ill, and delayed registration of foreign birth.In probate estates, the term "probate" refers to the manner of administering the property or estate by a personal representative under the jurisdiction of a Michigan Probate Court. The administration can be either unsupervised or supervised, and with or without bond. This deals with the amount of involvement by the Probate Court. There are numerous procedures and forms that must be filed with each type of case. Please refer to the attached handout for more information on probate estates.

Guardianship, conservatorship, and involuntary treatment of mentally ill individuals deals with the Probate Court appointing an adult to provide care and protection of the legal rights to an underage or incompetent person. These appointments can either be limited (providing the person appointed with limited amount of power) or full (where the person appointed is completely and legally responsible for the individual. ) Please see the attached handout for further information about these types of cases.
